The present one follows upon our letter of April 16,
1997.
After having examined the pled facts, we are of the
opinion that the behaviour of an investigation necessary is not had regard to the
circumstances and, in accordance with the powers that confers to us the article 65 of the
Law on the police organization, we refuse to hold it for the following reasons:
In his complaint, Mr Serge
Joseph Adrien Bourassa-Lacombe reproaches that not identified police officers, members of
the Montreal Urban Community, and with special constables in duty at the University of
Quebec in Montreal, their epic at the time of an incident which has occurred in the
buildings of the UQAM, August 16, 1995. On the one hand, he reproaches to the special
constables for having been handcuffed for supposed death threats that he would have,
according to them, made with one appointed of the Faculty of Law and, on the other hand,
with the police officers of the Montreal Urban Community, to have contacted him at the
request of the special constables as, finally, letting them release him.
However, there is
nothing derogatory with the Code of ethics for the Quebec police officers in these
reproaches addressed to the not identified police officers for Montreal Urban Community.
This only fact, we do not have any other alternative but that to refuse to hold an
investigation on their subject.
You have the right to make revise this decision by the
Committee of police deontology. If you want to exert this right, you will have to
deposit, in the 15 days of the notification of this decision, a written declaration
containing an explanation called upon with the support of your request for revision for

This 15 days deadline is required, i.e. the
Committee must have received your request at the latest the 15th day following
the reception by you of the decision of the Commissioner.
