To give a following to your meeting with mister Normand Couture, the last July18 ^th, it seem for me important to precise the procedure of the access to a medical file of the users like that is establish by the law on the health services and of the social services.

The law stipulate in effect that all user of more than fourteen years have the right to receive a written or verbal communication of his file. The user have also the right to be assist by a qualified professional to help to understand the contain of his file.

In the meantime, the law recognize also certain restrictions to the accessibility if the information's come from a third person and permit to identify this one or again if the communication of the file it is prejudiciary to the user. This last restriction is nevertheless limited in the time and the demand of the access could be deposit again at the establishment.

The user to whom we refuse the access to his file possess different petitions either, a request to on of the judge of the Superior Court or to a judge of the Court of Quebec. The user could also to address directly to the Commission of the access of the information or to the Welfare Commission

In the that concern you, so it is important to begin the procedure of the access to your file presenting yourself a request to the concerned establishment. I understand that your intervention by Regional State Control seek to recall that the demand send to Mister Legault April 24^th 1997 didn't received the anticipate following.
